On introduction of changes and amendments to Decree of President of Pridnestrovian Moldovian Republic of March 7, 2006, No. 101 On the prohibition of foreign funding of NGOs DECREE President of Pridnestrovian Moldovian Republic May 10, 2007 No. 340 According to clause 1 of article 72 of the Constitution of Pridnestrovian Moldovian Republic and in order to prevent excessive state regulation of non-commercial organizations, I hereby decree: 1. To add to the President’s Decree of Pridnestrovian Moldovian Republic of March 7, 2006, No. 101 “On the prohibition of foreign funding of NGOs” with changes and additions made by the Presidential Decrees of May 24, 2004 No. 131 and of March 27, 2006 No. 136, the following changes and amendments: a) The title of the Decree must read as follows: “On control of funding sources for public associations and political parties in PMR”; b) The text of the Decree must read as follows: “According to article 72 of the Constitution of the PMR and to the law on public associations of January 28, 2000 No. 240 with changes and amendments enacted by the laws of the PMR of July 10, 2002 No. 152-III (art 2-28) and of May 30, 2006 No. 35-IV (art. 06-23) and of July 25, 2006 No. 58-IV (art. 6-31), to the Law of the PMR on political parties of January 28, 2000 N. 239(art.00-1) with changes and amendments according to the Law of the PMR of May 30, 2006 No. 35-IV(art. 6-23) and of November 22, 2006 No. 122-IV (art. 06-48), in order to establish proper control over the funding sources for public associations and political parties in PMR, I hereby ordain: 1. To prohibit public associations, whose statutes stipulate involvement in electoral campaigns in accordance with the current legislation of PMR, their branches and representations, political parties, their structures and organizations, registered in the PMR, to receive money and property from: a) Foreign states and organizations; b) Foreign citizens; c) Individuals with no citizenship; d) International organizations and international movements, their branches and representations; e) Anonymous sources. An anonymous source is interpreted as a physical person who failed to indicate in the payment document any of the following information: last name, first name and father’s name, residence address, or indicated wrong information; or legal entity that did not indicate on the payment document any of the following information: name of the organization, fiscal code, bank details, or indicated wrong information. 2. Funds and other property received by public associations, their branches and representations, political parties, their structures and organizations that do not correspond to the requirements of the clause 1 of the present decree are subject to expropriation into the state budget based on court ruling. 3. To authorize the Ministry of Finance of PMR to control the sources of funding of public associations, their branches and representations, political parties, their structures and organizations; to file in court for confiscation of the funds and property received by public associations, their branches and representations, political parties, their structures and organizations that violated the stipulations of clause 1 of the present Decree. State executive bodies and the PMR National Bank must provide for sharing with the PMR Finance Ministry the information on funds received by public associations, their branches and representations, political parties, their
structures and organizations from sources mentioned in clause 1 of the present Decree, including all supporting documents. 4. Where it is established that the organizations, whose statutes stipulate their involvement in election campaigns in accordance with the current legislation of PMR, have received funds and property from the sources, indicated by the clause 1 of the present Decree, the PMR Ministry of Finance must inform the PMR Ministry of Justice and the PMR Public Prosecutor’s Office to take appropriate measures according to the law. 5.
